By accessing or using Magical Image ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

Magical Image provides AI-powered online visual content tools, including currently available features such as infographic generation and image card generation. Tools are available to both guest users and registered accounts.

New users receive a one-time trial credit grant. Registered users may purchase additional credit packs for more generation capacity.

You may use the Service as a guest without creating an account. To access additional features, purchase credits, or manage usage history, you must register for an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

Certain features of the Service require credits. Credits may be obtained through a one-time new-user trial grant or purchased credit packs.

All purchases are final and non-refundable unless required by applicable law. Credits have no cash value and cannot be transferred between accounts.

We use third-party payment processors (PayPal, Stripe) to handle transactions. Your payment information is processed solely by these providers and is not stored by us.

The Service uses AI models to generate images and other content based on your inputs. You are responsible for the prompts you submit and for ensuring they comply with these Terms.

We do not claim ownership of AI-generated outputs produced from your prompts. However, we do not guarantee that outputs are free from third-party intellectual property claims.

You agree not to use the Service to generate content that is unlawful, harmful, hateful, sexually explicit involving minors, or that infringes on the rights of others.

We may add internal provenance identifiers, file metadata, or other implicit markers to generated content to trace the generation job, user, timestamp, model, and prompt evidence. You may not maliciously remove, alter, forge, or conceal these markers.

To handle compliance, complaints, reports, payment disputes, regulatory requests, or legal requests, we may retain necessary request records linked to generated content, with access limited to authorized personnel.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations
• Attempt to reverse-engineer, scrape, or extract models or data from the Service
• Use automated tools, bots, or scripts to abuse the free credit system
• Resell, sublicense, or redistribute access to the Service without authorization
• Upload or generate content that infringes copyrights, trademarks, or other intellectual property rights
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to induce models to reveal, repeat, draw, or embed system prompts, hidden instructions, keys, or backend implementation details
• Generate political propaganda, political mobilization, impersonation of real political figures, or misleading images involving sensitive public events
• Generate sexually explicit, sexually suggestive, sexual-service, or any sexualized, nude, or intimate content involving minors

The Magical Image name, logo, website design, and underlying software are the intellectual property of Magical Image Team and are protected by applicable intellectual property laws.

Nothing in these Terms grants you any right to use our trademarks, trade names, or other proprietary designations.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will meet your requirements.

AI-generated content may be inaccurate, incomplete, or unsuitable for certain purposes. Use outputs at your own discretion.

To the maximum extent permitted by law, Magical Image Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

Your use of the Service is also governed by our Privacy Policy and Content Policy, which are incorporated into these Terms by reference.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, including for violations of these Terms.

Upon termination, your right to use the Service ceases immediately. Unused credits are forfeited and are not refundable.

These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction, as determined by applicable law.
